January, often referred to as “Divorce Month,” marks a notable spike in divorce filings. Studies, including research from the University of Washington, have observed that divorce rates consistently increase following the winter holiday season. While this phenomenon is not limited to the United States—similar patterns are seen in the United Kingdom—the reasons behind this trend are complex and multifaceted.

Why Do Divorce Filings Increase After the Holidays?

The holiday season is often seen as a time of joy, family togetherness, and fresh beginnings. However, for many couples, it can also magnify existing marital issues. The high expectations of the holidays, combined with financial pressures and increased time spent together, can exacerbate tensions in struggling relationships. Some couples hope the festive season will mend their differences, but when it doesn’t, they may resolve to part ways at the start of the new year.

Additionally, many individuals delay filing for divorce until after the holidays to avoid disrupting family celebrations or upsetting children. This leads to a backlog of decisions being acted upon in January, contributing to the spike in filings.

Interestingly, research shows that divorce filings also peak in March, several months after the holidays. This delay often reflects the time needed to organize finances, consult with attorneys, or summon the courage to take this significant step.

The seasonal trends in divorce filings are part of broader patterns that highlight societal and personal factors influencing marriage dissolution. Here are some key statistics:

  • First Marriage Divorce Rates: Approximately 41% of first marriages in the U.S. end in divorce.
  • Gender Trends: Women initiate divorce in 69% of cases, compared to 31% initiated by men.
  • Subsequent Marriages: Divorce rates increase with additional marriages, rising to 60% for second marriages and 73% for third marriages.
  • Common Causes: A long-term study found that 75% of respondents cited a lack of commitment as the leading cause of divorce.

All is not discouraging news, however, as the overall divorce rate in the United States has actually been declining since 2008.

From 2008 to 2022, the divorce rate in the U.S. dropped from just over 10.0 to about 7.0. In 2022, the divorce rate was 2.4 per 1,000 people, which is a significant decline from 2000, when it was 4 per 1,000. The marriage rate in the U.S. has remained between 16.0 and 18.0 since 2008, with the exception of 2021 when it fell below 15.0.

Some reasons for the decline in divorce rates include:

  • Many people getting married today are more educated, socially, and economically stable than in the past.
  • More adults are choosing to stay single or live alone for longer.
  • People are marrying later in life, which can reduce financial stressors and lead to more thoughtful unions.
  • More couples and individuals are participating in counseling and learning the necessary skills towards working out their differences.
